Srinagar, August 24: Two accused persons namely Mohammad Yaqoob Beigh and Abdul Aziz Bhat were caught by the officials of the Forest Department on 3rd August 2017 while cutting the trees in forest compartment 44/N Kulgam. Accordingly an FIR number 194/2017 under section 379 RPC, 6 Forest Act was registered against them in Police Station Kulgam and investigation was taken up.

        The case was challaned and was tried in JMIC Kulgam. The prosecution produced witnesses and after evidence was recorded, the case was finally agreed. LD. PO for state Mr. Muzamil Rashid has greed that the prosecution has succeeded in providing the guilt of accused beyond shadow of reasonable doubt as the prosecution has established the fact of cutting of forest tree by the accused persons, the seizure of timber and presence of accused persons are already established by the prosecution.

        Ld. Judicial Magistrate 1st class while agreeing with the arguments advanced by Ld PO has sentenced the accused persons to simple imprisonment sent for a period of one year and in the fine of Rs 1000/ each for the commission of offences under section 379 RPC and for a period of six months and a fine of Rs 1000/ each for the commission of offences under section 6 Forest Act.
